5710 Cleveland, LLC - Event Liability Waiver
This Liability Waiver Agreement ("Agreement") is entered into as of [Date] by and between the pParticipant("Participant") and 5710 Cleveland, LLC, a [State] Limited Liability Company located at 5710 Cleveland, Cleveland, Ohio ("Company").
1. Acknowledgment of Risks: Participant acknowledges that they are aware of the nature of the activities conducted at 5710 Cleveland, LLC ("Activities"), including but not limited to the use of dungeon equipment such as paddles, benches, and other gear. Participant understands that these Activities involve inherent risks and dangers, including but not limited to physical injury, psychological stress, or even death. Participant freely accepts and fully assumes all such risks, both known and unknown, even if arising from the negligence of the Company.
2. Use of Equipment: Participant agrees to use all equipment responsibly and by any instructions provided. Participant acknowledges that failure to use the equipment as intended may result in injury.
3. Health and Safety: Participants declare that they are in good health and suffer from no medical condition, which would be exacerbated by participating in the activities. Participant understands that the Company is not responsible for conducting health screenings for conditions such as STDs or COVID-19. Participant assumes all responsibility for assessing their personal health risks before participating in any Activities.
4. No Liability for Personal Property: The participant acknowledges that the Company is not responsible for any personal property brought to or left at the event location and that such personal property is brought at the PParticipant’sown risk.
5. Release and Waiver of Claims: Participant hereby releases, waives, discharges, and covenants not to sue 5710 Cleveland, LLC, its owners, employees, agents, and volunteers from any liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by PParticipantor to any property belonging to participants while participating in the Activities or while on premises where the Activities are being conducted.
6. Indemnification: The participant agrees to indemnify and hold harmless 5710 Cleveland, LLC from any loss, liability, damage, or costs that may be incurred due to the participant's participation in the Activities.
7. Understanding of Terms: The participant acknowledges that they have carefully read this Agreement, understood its contents, and signed it voluntarily. The participant agrees that no oral representations, statements, or inducements have been made apart from this Agreement.
8. Severability: If any provision of this Agreement is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions.
9. Acceptance: By signing below, PParticipantconfirms that they are at least 18 years of age and have the right to contract in their own name. Participant acknowledges that they have read this entire agreement, understand it fully, and agree to be bound by its terms.
